BOOKING TERMS & CONDITIONS: NEWHILL FARM COTTAGES
Thank you for booking Newhill Farm Cottages. We look forward to welcoming you here and we hope you have an enjoyable stay. Please read these Terms and Conditions carefully, as by making a booking and payment to us, you are deemed to have read and accepted them. ‘The Owners’, ‘we’, ‘us’ and ‘our’ means Kate and/or Ian Greig. ‘You’, ‘Your’ means all guests included in your booking group.
Booking your holiday
A booking contract shall only exist when your booking is confirmed in writing by us. When you submit a booking via our online reservation system, you will receive an automatically generated booking summary by email to the email address you have provided in the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing by us, via a letter of confirmation sent to you by post or email and payment is received. The contract between us is in terms of Schedule 4 Section 8 of the Housing (Scotland) Act 1988 and confers on you the right to occupy the property for the period agreed for holiday purposes only. The person making the booking must be at least 21 years of age. We have the right to refuse any booking. We are unable to accept stag or hen bookings. We reserve the right to take a pre-authorised security deposit on the lead bookers credit card of £250 per cottage booked. If required, this will be made clear to you pre-arrival or upon arrival.
Payment and Prices
A non-refundable deposit of 25% is payable on booking. This deposit is payable within 48 hours of the booking, or we may be obliged to release the dates. Payment can be made by credit or debit card or electronic bank transfer. Guests are liable for any bank or credit charges. The balance of your holiday is payable no less than 8 weeks before your arrival date. If you do not pay the full outstanding balance due in relation to your booking by the due date, we reserve the right to cancel the booking. For bookings made less than 8 weeks in advance, payment in full is needed to secure the booking.
Changing or cancelling your booking
If you wish to change any detail of your booking, you must notify us as soon as possible and we will do our best to accommodate your request. Additional rental costs may be due as a result of any changes. Booking date/property changes are not normally possible within 8 weeks of your arrival date. If you have to cancel your booking, you must contact us as soon as possible and send confirmation in writing. We will confirm the cancellation with you. If you cancel your booking, we shall attempt to re-let the booking dates. If we are successful in re-letting the booking and you have already paid for your booking in full, we will refund the balance payment to you (minus any shortfall in the rent achieved). In all cases, the 25% deposit payment is non-refundable. Due to unforeseen circumstances, we have the right to change or cancel your booking. If we need to cancel your booking for any events within our reasonable control, we would refund all monies paid by you for the booking. This does not include events outside our control, including extreme weather, natural disasters, strikes, riots, industrial action, terrorist activity, war, invasion, epidemics, diseases or limitations of power, transport or communication systems. Our liability would not extend beyond this refund. We strongly advise you to take out sufficient travel/cancellation insurance to cover you for your total holiday.
Property Details
Website, email and written communication are as accurate as possible. There may be minor differences between the actual property and its description. Occasionally, problems occur such that some facilities/services are not available or are restricted. We cannot be held responsible for the mechanical breakdown of equipment such as boilers, cookers, pumps, swimming pool or hot tub systems, nor for the failure of public utilities such as electricity. We (or our representatives) reserve the right to enter any property at a reasonable time for emergency maintenance or repair or any other need.
Number of Guests
The number of guests occupying each cottage must not exceed the maximum number permitted. Horse Mill Cottage (6 Guests), The Old Cart House (4 guests) and The Old Stables (4 Guests). Children over the age of 2, not sleeping in a travel cot, count towards the total number of guests. Infants (under the age of 2) are exempt from this number. We reserve the right to terminate a booking and require the immediate removal of any persons in breach of these conditions. Sub-letting is strictly forbidden. Day guests are welcome to visit, by prior arrangement only, but are not permitted or insured to use the leisure facilities.
Arrival/Departure
Arrival at the property is from 4pm on the day of arrival, unless otherwise arranged. We cannot be held responsible for any property not being ready should guests arrive earlier than 4pm. Departure must be by 10am on the last date of your holiday. You agree to leave the property in a clean and tidy manner. We reserve the right to make a charge if the cottages are left in an excessively dirty condition. Please report any breakages or damage before departure. You are responsible for the cost of any breakages or damage in or to the property caused by any of your group. We have the right to ask you to leave if we have reason to believe that any of your group are behaving in an illegal way or causing damage to the property.
Leisure Facilities
Leisure facilities are only available for use between 9am and 9pm each day. The pool house will be closed on the morning of departure. The 3 cottages at Newhill Farm have shared use of all leisure facilities. Safety Instructions are provided for the safe use of each individual leisure facility (swimming pool, hot tubs, tennis court, outdoor children’s play area, games room/gym). Please read and follow any safety advice. Glass objects, glitter/confetti inflatables, hard style footballs or high powered water pistols/guns are not permitted in the pool house or in/near the hot tubs. Access to the swimming pool building is within your own control and it is your responsibility to ensure that you supervise all children and vulnerable adults. Children 16 years of age and under must be supervised at all times.
Inclusive Items
Domestic electricity, oil fired heating, bed linen, duvets, bathroom/kitchen towels, leisure towels, freesat TV and wi-fi. An initial complimentary basket of firewood is provided for each cottage. Additional logs thereafter at a small fee. Cots and highchairs are available free of charge, but guests are required to supply their own cot bedding.
Electric Vehicle Charging
Electric vehicle Charging is only permitted using the pre-paid EV Charging Station. EV Charging from the cottages/leisure buildings via a standard/granny charger using the electric circuits is not permitted and is a safety/fire risk.
Pets
Dogs are welcome at the cottages, but only by prior agreement. We allow 1 Dog per cottage for an additional charge of £30 per dog. Dogs are not permitted upstairs, or on the furniture and must not be left in the cottages unattended. When possible, please exercise your dog away from the cottages and ensure that you clean up after them. Pet owners must ensure their pets are kept under control and do not cause unreasonable annoyance to our other guests. Dogs are not permitted inside any of the leisure buildings or play areas.
Smoking
All cottages and leisure buildings are non-smoking. Smoking is permitted outside only. Please use the cigarette bins provided.
Wi-Fi
We provide free wireless internet access in each cottage. We are the legal owners of this supply. Please do not view, email or download any illegal, offensive, pornographic or otherwise unlawful or inappropriate material.

In summary, any information collected by us during the course of processing bookings and enquiries is treated with strict confidence. We retain this information and we may use it to provide you with holiday or special information. We will never pass your information on to third parties.
Liability
We do not accept any liability for any damage, loss or injury to any member, visitor or animal in your group or any vehicles or possessions, unless proven to be caused by a negligent act by ourselves or our staff or contractors. Guests are requested to take care at all times whilst on the premises. Parents are asked to ensure that children are safe, accompanied/supervised by a responsible adult and not left unattended. We want your stay with us to be enjoyable, but should you have any cause for complaint, please advise us immediately and we will do our best to resolve the matter. Complaints cannot be accepted after your departure.
